  3. Read more carefully. (One would have thought you would have learned THAT in law school.) They lost on the argument and they lost on the issues before the Court in the matter you cited. Reading more carefully also would have allowed you to avoid making the original misstatement that Pottinger had anything to do with immutable status. Being more honest would allow you to admit your error. Again, being homeless is not, never has been, and never will be, an immutable status. One does not have to have graduated from law school to understand this basic fact.
  4. The signage on the Hilton Americas, Marriott Marquis, Westin, Embassy Suites, Hampton Inn, and Homewood Suites hotels and the signage on the former Doubletree downtown suggest that a downtown Hard Rock Hotel would also be allowed to have signage.
  5. LOL Yes, they made the argument (drawing invalid conclusions from the Florida case and misusing the word "immutable"... Whatever the ACLU's expertise, it is a simple matter of fact that homelessness is NOT an immutable condition.) And the Court shot the argument down. They LOST.
  6. Odd that you chose to end your quote right there. The very next words in the Houston case: "This Court does not agree." A plaintiff attorney's misuse of a word does not change the word's meaning. Or perhaps the attorney really believes that homelessness is an immutable status (once homeless, forever homeless).

  10. Thanks for those references. To be clear, the court in Pottinger did not base its opinion on homelessness being an immutable status (and it would have been foolish to do so; homelessness is not an immutable status).
  11. They cut windows into it (on both the 1st and 2nd floors), so it looks like they must be keeping it.
  12. To be clear, I am referring to the reddish material underneath the upper-floor windows (floors 3 and up). I don't know if it's limestone, but that's what I thought you were referring to. I guess when you said limestone, you were perhaps referring to the white marble on the the first two floors?

  14. No. The angle is wrong for it to be from the roof of the Holiday Inn. It has to have been taken from the roof of the former Days Inn/Heaven on Earth. Edit: Confirmed. The post on Reddit says it was taken "From the Roof of the Old Days Inn."
  15. The prices seem to be pretty well in line with comparable mid- and high-rise buildings in Houston. FWIW, the four units that are listed on HAR are listed at $611.61, $694.20, $659.97, and $949.71 (penthouse) per square foot.

Or at least the people who operate The Jones On Main (and presumably also the people who own it), seem to be under the impression that the Shake Shack space is part of The Jones on Main. The entire block is under common ownership and is included in the retail marketing materials for The Jones on Main.

  22. Oops. I kinda forgot. 1st Quarter, 2019: A net 95 units were absorbed in the CBD, while zero new units were delivered. (Assuming 1.4 people per occupied apartment, downtown added about 44 people per month during the 1st quarter. Certainly a slow down, but still growing). Up to 86.8% occupancy. The "Central Houston" market (downtown, Montrose/Museum/Midtown, Heights/Wash Ave., Highland Village/Upper Kirby/West U, and Med Center/Braes Bayou) delivered 324 new units during the quarter, with 628 units net absorption.
